BULLETIN
The Energy Regulators Regional Association (ERRA) organized the Legal Regulation Working Group meeting on November 9-10, 2006, in Tallinn, Estonia. The meeting was organized by the Energy Regulators Regional Association (ERRA), co-hosted by the Energy Market Inspectorate of Estonia (EMI) and supported by the U.S. National Association of Regulatory Utility Commissioners (NARUC), with funding provided by the U.S. Agency for International Development (USAID).
Representatives from 17 full ERRA membership organizations participated, namely from Albania, Armenia, Bosnia and Herzegovina, Croatia, Estonia, Georgia, Hungary, Kazakhstan, Latvia, Lithuania, Moldova, Montenegro, Poland, Romania, Russia, Turkey, Ukraine, and an associate member from the Romanian Natural Gas Regulatory Authority. In addition, NARUC as an affiliate member delegated Commissioner Steve Gaw, Missouri Public Service Commission (MPSC) and Kimberly Ann Joyce, Pennsylvania Public Utility Commission. ERRA was happy to welcome Andrea Brandstätter from E-Control GmbH (Austrian Energy Regulatory Authority) and several EMI staff at the two-days meeting.
On Thursday, Chairman Margus Kasepalu (Deputy General Director, Energy Market Inspectorate of Estonia) officially opened the meeting and welcomed participants, which was followed by the election of the Vice Chairperson of the Legal Regulation Working Group. Irina Migunova from the Federal Tariff Service of the Russian Federation was elected as a Vice-Chair for a two-year term.
The first day of the meeting focused on discussion on the draft Issue Paper on Data Access and Public Availability. Irina Migunova, Federal Tariff Service of the Russian Federation and Viktoria Morozova, National Electricity Regulatory Commission of Ukraine jointly presented the main findings of the draft paper and results of the questionnaire. Commissioner Steve Gaw, MPSC gave an overview of the US experience on this topic. General agreement was reached that the draft paper will be further extended with the US experience. The morning session ended up with vivid discussions on the topics and suggestions for the Workplan for 2007. The afternoon agenda featured the topic of Legal arrangements for Long-Term Power Purchase Agreements’ (PPA) Termination and Payment of stranded costs. Intensive country case presentations opened Elena Dimitrova Marinova, State Energy and Water Regulatory Commission, presenting Bulgaria’s experience. Two more presentations followed: Hungarian lessons learned by Zsuzsa Portoro, Hungarian Energy Office and Polish experience by Alicija Tutak from the Electricity Regulatory Authority of Poland.
The second day started with a short overview of the results of the inquiry among ERRA member-states on the Court Appeals against Tariff Decisions by the Regulator, presentation was lead by Hamik Amiraghyan. Main issue of the day was the topic of the Legal framework for energy market liberalization. Country specific aspects of this theme were highlighted in the presentations of Andrea Brandstaetter, E-Control GmbH (Austrian Energy Regulatory Authority), Mihai Goage, National Natural Gas Regulatory Authority of Romania, Galiya Joldybayeva, Agency for Regulation of Natural Monopolies of Kazakhstan and last, but not least by Kimberly Joyce, Pennsylvania Public Utility Commission, USA.
Irina Migunova from the Federal Tariff Service of the Russian Federation delivered a presentation dedicated to the Legal Issues Related to the Functioning of the Wholesale Market in the Russian Federation. Finally, Viola Dozsa updated participants ont he latest ERRA developments. |
