BULLETIN

The U.S. National Association of Regulatory Utility Commissioners (NARUC) and the Energy Regulators Regional Association (ERRA) organized the Regulatory Participation & Communication Workshop on October 26-27, 2005 in Kiev, Ukraine. The meeting was co-hosted by the National Electricity Regulatory Commission of Ukraine (NERC), and funded by the U.S. Agency for International Development (USAID). Objectives of the workshop were to identify a common understanding of why transparency and public participation in regulation are important and what it means; identify best practices and issues/problems; develop options for how to improve transparency/public participation; identify needs training and potential new ERRA activities.

60 Senior Representatives from 20 ERRA member organizations participated, namely from Albania, Armenia, Bosnia and Herzegovina, Bulgaria, Croatia, Georgia, Hungary, Kazakhstan, Kosovo, Kyrgyz Republic, Latvia, Lithuania, Macedonia, Moldavia, Mongolia, Montenegro, Poland, Romania, Russia, Ukraine. In addition 4 US staff persons (from the California Public Utilities Commission, the Missouri Public Service Commission and the National Association of Regulatory Utility Commissioners) attended the meeting. Representatives from other energy stakeholders, including the media and NGOs from Bulgaria, Georgia and Ukraine also participated on the Workshop.

The two-day meeting focused on the following Public Relation issues:
• Regulatory Information (how does the regulator communicate decisions, processes, procedures, including hearings, notification, etc.; how does the regulator interact with the public, media, parliament, government/ministry officials, NGOs, and other energy stakeholders)
• Public Participation (increase in public interest and understanding of issues, increase in public support for the regulatory process, what roles do various groups play – i.e., public, media, parliament, government/ministries, NGOs, etc)

The first day session, moderated by Mr. Ron Eachus, Independent Consultant (former Chairman of the Oregon Public Utilities Commission, USA) on the Regulator’s Public Relations & Information Process included the subtopics such as the General Overview (Structure, tasks, organization, governance and financing of energy regulatory institutions’ public relations; consumer protection, customer complaints, dispute resolution, public information, communication (web, media), accountability, etc.); Communication: Getting the Regulator’s Message Across (How does he regulator communicate tariff and license applications, public hearings, rate cases, major decisions, changes in legislation/procedures with the public?) and Lessons Learned: The Regulator’s Experiences with Stakeholders. The day ended with the roundtable discussion on the best practices.

The 2nd day was dedicated to the session on the Public Participation in the Regulatory Process. This session focused on how to increase public interest and understanding of regulatory issues and expand public support for the regulatory process. Participants discussed the various roles the different stakeholder groups (public, media, parliament, government/ministries, NGOs, large/small consumers, etc) play in the regulatory process. Subtopics included: General Overview: The Need for Public Participation & Regulatory Transparency; Data Information: What Does the Public Need to Know and When?.

After the intense presentations, participants engaged in roundtable discussions on drafting the basic Consumer Code of Rights, which has been moderated by Commissioner Steve Gaw, Missouri Public Service Commission, USA. The afternoon session has continued with the presentation on the Educational Program for PR Specialists and Regional Tariff Regulators organized by the Federal Tariff Service of Russia. e
