| Summary |
- The Nigerian Electricity Regulatory Commission was established in 2005, following the Electric Power Sector Reform Act, 2005
- Number of employees: 109
- The Ministry of Power is responsible for policy formulation. The Commission however reports to the President and the National Assembly.

- Governance (Board of Commissioners):
NERC has a Board of 7 Commissioners one of whom is Chairman and Chief Executive Officer. They are appointed for an initial term of four years with an option to renew for another 4 years and no more. They are nominated for appointment by the President but their nomination must be approved by the National Assembly (The Parliament).
- Responsibilities:
Electricity Regulation(issue licenses and permits, establish tariffs, promote competition, establish and approve operating codes to ensure service supply quality, establish appropriate consumer rights and obligations, monitor the operation of the electricity market, protect grid stability, organize activities promoting the conservation of energy and renewable energy initiatives etc.)

| Industry and Market Structure |

NERC currently regulates 6 Government owned generation companies, one transmission company and 11 Government owned Distribution utilities. NERC has also issued 2 Distribution licenses to IPPs as well as 24 Generation IPP licenses. One of the private distribution companies is in operation while 9 of the generation IPPs are also fully operational. The Federal Government intends to divest its ownership of the 6 generating and 11 Distribution companies in line with the electricity sector reform programme. No date has been fixed for the divestment.
